A cleaning company boss who raped a teenage employee on her first day at work after plying her with alcohol during an ‘office party’ has been jailed.
The shocking details can be revealed after the man, who legally cannot be identified, was found guilty of raping the young migrant employee, 18.
The court heard the teen did three-hour trial shift on the Friday at a cleaning company the man owned in Sydney’s inner-west.
She started on the job three days later on the Monday, where she was called into the ‘party’ that afternoon.
‘There are more drinks in the fridge. We are going to enjoy the night. We are not going to let anyone go until 10pm,’ the boss told the staff, news.com.au reported.
The court heard he asked the new employee multiple times why she wasn’t drinking.
The teen told her boss that she didn’t drink often, she only had an apple for breakfast and weighed just 51kg.
She was then encouraged to have scotch and tequila shots with the group.
The teen later became ill and vomited from the alcohol consumption, which was witnessed by the boss.
The court heard he then led the teen back into his office, took off her clothes and raped her.
The court heard that the teen’s older sister called her multiple times during the rape.
The man answered the phone and hung up before he continued to rape the teen.
‘There was nothing in which would suggest that she might have consenting or been willing to consent in circumstances where he was [significantly] older than her,’ NSW District Court Judge Michael King said.
‘She was an entirely new employee and [it was] in circumstances where she had worked at the business for just one day.’
Judge King pointed to the fact that since the boss saw his victim vomit, he would have known she was highly intoxicated.
‘The accused was aware that she was substantially affected by alcohol and was not consenting to the sexual intercourse,’ he said.
‘She became, in effect, frozen and unable to move and wasn’t aware of what was happening.’
The court had also heard that while the man was raping the teen, he kept asking her if she had a boyfriend and if she liked him.
After the rape, the teen managed and walked to the nearest train station, where her sister eventually found her.
‘Her sister said she was crying, her hair was a mess and her clothes were not on correctly,’ Judge King said.
The teen called her boss asking: ‘Why did you do this to me? I can’t work tomorrow. How I come and work there? You already did this to me?’.
But the man denied any wrongdoing and the teen reported the rape to police.
The cleaning boss was charged with two counts of sexual intercourse without consent and one count of sexually touching another person without consent.
Judge King court the court the man still did not understand his offending and has continued to deny his acts were non-consensual.
The man was jailed for five-a-half years.
He must serve two years and nine months before he’s eligible for parole in June 2027.
The Nepalese man arrived in in July 2019 so he could join his wife, who had already moved to four months earlier.
He will likely be deported when his sentence is completed.
