The jury in Sean ‘Diddy’ Combs’ sex-trafficking and racketeering trial winced after they were shown videos of his infamous Freak Offs on Monday.

It comes after Judge Arun Subramanian  dismissed a juror after concluding that his conflicting answers about where he lives might indicate he had an agenda or wanted to stay on the jury for a purpose.

Diddy’s lawyers had said they would demand a mistrial if the state’s request to have the juror dismissed over inconsistent statements was granted. They argued in a letter to Judge Subramanian that there was no valid basis for the dismissal and it would discriminatory to dismiss the juror. 

But the judge decided juror #6 would be booted and replaced with an alternate – and he gave stern comments to the defense for making the juror dismissal issue about race, saying it would be ‘improper’ to make the decision based on the juror’s races.’

The judge said Diddy ‘has not got the right to a boutique jury’ that mirrors his own race.

The prosecution is expected to wrap up their case over the next days. 

Diddy, 55, has pleaded not guilty. If convicted, he faces 15 years to life in prison.

Shock among the jury as they view Freak Off videos in court

A black female juror furrowed her brow and winced Monday while watching the first of three clips of the Freak Offs, which ran from 20 or 30 seconds.

Another black female juror moved uncomfortably in her seat and put her head to her head as she watched the footage.

Two of the films lasted 11 minutes and a third was 39 minutes but jurors were only shown a small amount.

The videos were only shown on a prosecution laptop and to the jury, who wore headphones.

Music could be heard faintly in court from the videos and what appeared to be groaning.

The videos were taken in October 2012 where records shown to the jury indicated that Diddy’s ex-girlfriend Cassie Ventura was taking part in a Freak Off at the Trump International Hotel in New York with two male escorts.

One of them was known as ‘The Punisher’ and the other was called Dave.

Jurors have previously been shown stills from the marathon sex sessions.

Testimony reveals Diddy's favorite show

Diddy, the subject of several true-crime TV documentaries, is a bit of a true-crime fan himself.

Jane revealed this week that his favorite show is Dateline, the magazine-style NBC stalwart that is heavy on murders and mysteries.

She told jurors that, in their alone time together, she and Combs would watch Dateline for hours ’till we fell asleep.’

Other activities when it was just the two of them included hugging, cuddling and bathing Combs, and giving him foot rubs, Jane testified.

Prosecutors will rest their case as soon as Tuesday, they told the court.

It will then be the turn of the mogul’s defense attorneys to make their case to the jury.

They are expected to finish presenting their case after two weeks.

It will then be time for closing arguments, before the jury begins deliberations.

Diddy and the 'nerd defense' strategy

Diddy has been sporting a much different look during his trial than he did while he was a free man, sparking speculation that he could be trying ‘the nerd defense.’

His hair and goatee are now nearly all white, as the mogul no longer has access to Just For Men hair dye that was found in his Miami mansion.

He has also been pairing black framed glasses with a white collared short under a neutral toned sweater, as noted by The New York Times.

The ‘nerd defense’ is based on the idea that dressing defendants in glasses has a subliminal effect on the jury, which will see the accused as someone less likely to engage in criminal activity.

The term was actually coined by Harvey Slovis, who represented Diddy during his 1999 trial for gun possession.

TMZ reported Monday that the judge in Diddy’s trial is concerned about another juror – after juror #6 was dismissed this morning.

Judge Arun Subramanian is worried about a juror talking about the case outside of court.

The juror in question apparently alerted the court on Friday to a mystery text from a number he did not recognize asking if he was juror #6.

The juror said he did not recognize the number, but the judge was still concerned he might be discussing the trial outside of the jury.

After Cassie filed her lawsuit in November, 2023, D-Roc texted Diddy: ‘Love you man, if you need a friend, I’m here.’

Diddy replied: ‘I’ll call you back, talking to the kids.’

D-Roc, who gained notoriety as one of Biggie Small’s entourage members, then texted one of Diddy’s former assistants, who testified under the pseudonym of ‘Mia.’

The rap mogul himself could take the stand and will be able to decide if he wants to up until the last minute, but his lawyers will most likely advise him not to do so.

So far, the blockbuster trial has consisted of a number of bombshell testimonies from his ex-girlfriend and main accuser Cassie Ventura, rapper Kid Cudi, Dawn Richard, a former member of Combs’ pop group Danity Kane, and his former executive assistant George Kaplan, among others.

‘No but you should talk to him,’ Cassie texted Diddy’s chief of staff when asked if she was okay in May, 2017.

‘No one deserves being dragged by their hair. I locked the door for my safety.

After Cassie noted that Diddy tohairok her belongings, Khorram said she would talk to the mogul to help her get her things back.

In April, 2018, Cassie texted Khorram: ‘I can’t do the violent, scar, kick me out of my own house stuff anymore….I just can’t any more.’

Khorram said: ‘stay focused, it’s not worth derailing, that much I know.’

Mystery rapper at the center of court chaos

Diddy’s lawyers on Thursday morning spoke about an event in January 2024 involving Jane in a hotel room in Vegas and how it was important that they be able to use some names that they are prohibited from doing by the anonymity order around the witness.

Doing so would allow members of the public to ‘come forward’ if they had information that might help the case. Agnifilo said that using the names was ‘important’.

Prosecutor Maurene Comey said that doing so would be a ‘pretext to harass and intimidate this witness’ and that enough had been revealed already so that anyone who had information about that event could.

The judge agreed and said he wouldn’t modify the order to allow the names from this episode to be used. The judge said this was a ‘collateral issue’ and not related to the sex trafficking charges.

Once she was back on the stand, Jane explained that in January, 2024, she traveled to Vegas with a famous rapper and his girlfriend on a private plane.

Jane said she saw Anton, one of the male escorts, having sex with someone while the rapper and his girlfriend watched.

Diddy’s lawyer said Diddy and the unnamed rapper ‘were really close to one another’ and he is ‘at the top of the music industry.’

Jane said she was aware Anton had a relationship with the rapper and often traveled with the male escort.

Jane said she flirted with the rapper and flashed her breasts at the party and claimed the rapper said he had always had a crush on her.

Ananya Sankar, a paralegal for the U.S. Attorney’s Office, was the first witness called to the stand by the prosecution on Monday.

Judge Arun Subramanian ruled on Monday morning that juror #6, a black man, will be dismissed from the jury and replaced with an alternate.

The judge said he had ‘concerns about his candor and whether he shaded answers to get on and stay on the panel.’

The defense over the weekend had argued there was no valid basis for the dismissal and it would discriminatory to dismiss the juror.

‘All of this was part of a coordinated effort to try to destroy one of the most successful black men in American history,’ Diddy’s lawyers said in a letter.

Juror #6 is a 41-year-old black man who works in communications at a correctional facility.

On Monday, the judge said: ‘The defense raised concerns about replacing an African American juror with a white one… . The Court takes this seriously- but further questioning is inappropriate and might negatively impact the jury. This is why we have alternates.’

The judge admonished Diddy’s attorneys for making the juror dismissal issue about race, saying it would be ‘improper’ to make the decision based on the juror’s races.’

The judge said Diddy ‘has not got the right to a boutique jury’ that mirrors his own race.

Diddy didn’t seem phased and stretched his arms in the air as the judge spoke.

Juror #6 could be booted from Diddy trial after 'inconsistencies' in his statements

Judge Arun Subramanian said on Friday that juror #6 should be dismissed because of inconsistencies in his statements about his place of residency.

These changes suggested an ‘effort to try to get onto the jury’ the judge said.

‘In the robing room he said the daughter lived in New Jersey. Then he said, in The Bronx, with his aunt. In the voir dire he said he lived with his girlfriend – who lives in New Jersey. These are inconsistencies,’ the judge said.

‘The reason we have alternate jurors is if questions arise. Where there’s a question like this, removal of the juror is required. The juror will be dismissed, he should not return on Monday.’

Diddy shook his head after the judge made the comments.

His lawyers had suggested prosecutors wanted the juror out because he was black and strongly opposed the juror’s dismissal.

The defense then said over the weekend they plan on demanding a mistrial if the juror is dismissed.

Judge Subramanian said he will make a ruling Monday morning.
