An Afghan refugee released from immigration detention after a controversial High Court ruling has been charged with two counts of indecent assault.

Aliyawar Yawari, 65, appeared in the Adelaide Magistrates Court on Monday less than a month after he walked free from Yongah Hill Immigration Detention Centre in Western .

Police arrested Yawari at the Pavlos Motel in Pooraka in Adelaide’s north on Saturday night after allegations a woman had been assaulted by a guest.

He did not apply for bail and has been remanded in custody until January. 

Yawari was previously accused of attacking three women and was convicted of assault in 2016.

The High Court’s decision on November 8 allowed 148 dangerous non-citizens to be released from detention.

n Border Force said a second man from the group has also been charged in New South Wales with drug possession.

Mohammed Ali Nadari, 45, was allegedly found with cannabis in Western Sydney after recently being released from immigration detention. He has been released on bail. 

Yawari was previously described by a judge as a ‘danger to the n community’ and has served a jail term for assaulting three women including one he hit with her own walking stick.

The manager of Pavlos Motel – who gave the name Happy Mann when contacted by Daily Mail – said Yawari had seemed like an ideal guest until the police turned up and told him of the alleged assault.

‘He was really good,’ Mr Mann said.

‘He just talked to me a few times but it was all good, I didn’t feel suspicious of anything.’

Mr Mann said Yawari had been staying at the motel for a ‘couple of weeks’ and denied any knowledge of the alleged assault.

‘Nobody knows what happened – just the police know. They told us yesterday that he’d been charged,’ Mr Mann said.

Guri Bhullar, who works on the motel’s front desk, later confirmed Yawari had checked in on 14 November and described him as ‘no trouble, always quiet – a good guest’.

‘He didn’t like to speak much, he didn’t come to reception too often so we didn’t have much chat,’ Mr Bhullar said.

‘He was a quiet person, not a troublesome person: he used to stay in his own room.’

Mr Bhullar was not working on Saturday night and did not hear of the alleged assault until later.

‘The lady just called the police – she didn’t come to reception for any complaints that he was (allegedly) disturbing her,’ he said.

‘We just knew when the police came to the hotel.’

It is understood Yawari was wearing an ankle tag at the time of his arrest.  

Yawari had arrived in in 2010 after fleeing Afghanistan where his father and brother were killed by the Taliban. 

He found work in Bordertown in South but between October 2013 and December 2014 he carried out attacks on women in rural parts of the state. 

In 2013 he was acquitted of rape but convicted of assault and received a suspected prison sentence.

But in 2016 he was sentenced to three years and 11 months with a non-parole period of two years and eight months.

After his sentence he was sent to immigration detention awaiting deportation but was released in November after the High Court ruled indefinitely holding refugees was unlawful.

‘The Government was asleep at the wheel when the High Court handed down its decision that resulted in the release of criminals from immigration detention,’ Mr Tehan said.

He claimed the Albanese government should have had ‘a preventive detention regime, ready to go to protect the n public’.

Legislation was rushed through last month to monitor and place under curfew the detainees released into the community. 

‘The n people rely on their governments to keep them safe. On this one crucial measure, the Albanese Labor Government has failed,’ Mr Tehan said.

He labelled the governments response chaotic and called for the two ministers to resign to restore trust.

‘If they don’t, the Prime Minister must sack them. This is a test for Anthony Albanese.’
