A recently divorced husband has issued a legal notice to a porn website, claiming its ’emotionally coercive marketing’ is the reason his marriage broke apart. 

The man, who hails from Brazil, subscribed to the adult site TopFans after coming across a sponsored link during a ‘moment of emotional vulnerability’. 

Daily Mail can reveal the man, who will remain anonymous for legal reasons, is trying to sue TopFans, demanding compensation for ‘marital damages’. 

He claims his subscription, triggered by what he calls a manipulative , resulted in growing marital conflict.

‘I, [the man’s name], hereby formally notify the company TopFans of its indirect responsibility for the end of my marriage,’ he wrote tp the business.

‘I was impacted by a sponsored link from the platform during a moment of emotional vulnerability.’

‘The subscription, motivated by advertising impulse, triggered a series of marital conflicts that led to separation,’ he continued.

He went on to say in his legal notice, which was originally written in Portuguese and issued on 29 July, that ‘the was broadcast in an abusive manner’.

The man said the marketing material didn’t consider ‘the consumer’s emotional state’ or warn him ‘about possible psychological consequences’.  

He then demanded a public apology, a review of the company’s advertising strategies, and compensation for ‘moral and marital damages’.

‘If there is no response within 15 days, I will take the appropriate legal measures to obtain full compensation for the damages suffered,’ he finished.

TopFans CEO Alexandre Peccin has said he will not give in to the demands of the consumer.

‘No one subscribes by accident. The choice is always personal,’ he said in a statement.

‘We believe in the autonomy of those who access our platform.’

‘We offer content for adults, with freedom and respect—but we cannot control personal choices or relationships,’ Peccin added.

He went on to say all TopFans campaigns follow the advertising rules set by social media platforms and are exclusively shown to users of legal age.

‘TopFans remains committed to freedom of choice, consent, and individual responsibility,’ he continued.

‘Any attempt to shift personal responsibility to the platform distracts from the real discussion around autonomy and online behaviour.’

The 15-day response period for the legal notice ended on 13 August, but a TopFans spokesperson has since revealed to Daily Mail the man has not yet taken the matter to court. 

‘The company has not responded to [the man] directly beyond the official statement [written by Peccin] as TopFans prefers to handle such matters through proper legal channels rather than private exchanges,’ the spokesperson said.
