The defense, which will present its case this week, says prosecutors are trying to criminalize sexual activity between consenting adults.
They admit their client was involved in domestic abuse, but argue he has not committed the federal crimes of sex trafficking and racketeering conspiracy.
Combs, 55, has pleaded not guilty to the charges.

Diddy told Jane he's 'serving orgasms and foodgasms' in explicit text exchange
In one text exchange from November 7, 2021 Diddy and Jane discussed their day as things got flirty very fast.
Diddy asked her: ‘Hey baby how are you?’
‘Hey cutie i’m good how’s your Sunday,’ she replied.
‘Pretty good, just got back from cooking for brunch,’ he wrote back, before going on to seemingly send her some sort of explicit image.
‘Sheesh you need to come with a warning signs (closed monkey face emojis),’ Jane said. ‘How’s the brunch lol these pics.’
‘It was good, they loved the food for the most part. Lol,’ he replied.
‘I’m serving orgasms and foodgasms,’ Diddy added.
‘(Laugh emoji) That’s def the first time I’ve heard that,’ Jane responded.
Defense reviews several explicit messages between Jane and Diddy
Teny Geragos, one of Diddy’s lawyers, presented several messages between him and his then-girlfriend – only identified as Jane – to federal agent Joseph Cerciello Monday afternoon.
The explicit messages showed Jane telling Diddy: ‘I’m horny for you’ and her appearing to mention a sexual act involving her, the rapper and his former personal trainer Paul Arthur.
Aurthur frequently participated in sexual acts with Diddy and women.
In one exchange, Diddy asked Jane: ‘Want me and Paul to stop by?’
‘I’m horny for you,’ she responded.
‘What u wanna do. Be explicit,’ Diddy said as Jane went into very graphic detail about what she wants to do with them.
The defense plans to show Diddy’s girlfriends consented and were not trafficking victims.
Defense cross-examination begins
After breaking for lunch Monday afternoon, the trial started back up with HSI Special Agent Joseph Cerciello returning to the witness stand to be cross-examined by Diddy’s lawyer Teny Geragos.
The prosecution ended before the break.
Will Diddy's lawyers be calling witnesses?
Diddy’s defense team has as of yet not called any witnesses for his trial.
It is not unusual for legal teams to opt against calling witnesses in a trial because the weight of it is completely based on the prosecution proving charges beyond a reasonable doubt.
His team’s decision to possibly not to call witnesses could mean they believe the trial has already established enough doubt during the cross-examinations.
It could also mean there are no witnesses available who could help the case.

Diddy demanded soup from high-end store and his Apple TV be delivered to him
Diddy was heard asking someone to bring him his ‘Apple TV system’ and vegetable soup from up-scale grocery store Erewhon in a voicemail to Khorram.
He also requested seven bottles of baby oils, two Alfred sliced vanilla lattes, four young coconuts and five bottles of astroglide.
In the recorded message, he was heard saying he wanted the items then and there because ‘I don’t have to call anybody’ about it later.
Diddy appeared to be reading something as texts were read in court
The 55-year-old donned a white sweater and glasses during court Monday.
He appeared to be reading something in his lap while texts between him and ‘Jane’ were discussed.

The defense used the audio in an attempt to prove that Cassie was an enthusiastic participant in the marathon sex sessions with escorts.

Kristina Khorram, Diddy’s former assistant and chief of staff, scolded her boss in a text exchange after she found out he was leaving parties with guests in Ubers.
‘Next time ya’ll decide to randomly leave you have to tell us,’ she told Combs.
‘That’s when bad shit can happen, you know this.’
Diddy then told her: ‘No, go to sleep.’
‘It’s not cool to do that cos if something were to happen we’d be f***ed. Puff seriously, that is reckless,’ she added.

Diddy left urgent voicemail for assistant after running out of baby oil
Jurors listened to a voicemail Diddy left for Kristinia Khorram in November 2021 informing her he ran out of baby oil.
In the voice message, Diddy told Khorram: ‘I can’t believe I’m out’ of the lubricant.
She then assured her boss that a new delivery would be left outside his door soon.
Over 200 bottles of baby oil and 900 bottles of astroglide lubricant were shown in evidence photos that came to light in court last week.
Male escort 'The Punisher' reveals sordid new Diddy 'freak off' revelation after video was shown to jury
A male escort who was allegedly paid to participate in Sean ‘Diddy’ Combs’ sex sessions known as ‘freak offs’ says he had no idea he was being filmed.
Exotic dancer Sharay Hayes, also known by his stage name ‘The Punisher’, claims he was given $800 to have sex with singer Cassie Ventura while Diddy watched in 2012.
He has now claimed he was unaware he was being recorded, after video of him having sex with Ventura was played to the jury in the disgraced rap mogul’s sex trafficking and racketeering trial in New York on June 16.
Jurors viewed several video clips of Ventura engaging in sexual acts with male escorts, whom prosecutors claimed were compensated by Combs, on June 17.

In further messages with Bridget Collins, the boss of the escort service Cowboys4Angels, Diddy critiqued the escort he booked.
‘LOL he couldn’t even perform,’ he told Collins.
‘You’re paying for the gentleman’s,’ she responded.
‘He’s lucky he got that,’ Diddy said.
Collins then replied: ‘It doesn’t matter what happens on an appointment..(you could go skydiving).’
‘I’m not trying to be smart to you. Talk nice to me because I always talk nice to you. Being I’m a longtime customer,’ the music mogul said.
‘I’m sorry if I came across as anything other than disrespectful….sometimes,’ Collins stated.

More photos of damning evidence against Sean ‘Diddy’ Combs came to light on Thursday, including a collection of high-powered rifles, drugs and hundreds of bottles of baby oil.
The trove of photos were released by federal prosecutors as the trial at Manhattan federal court was stalled due to the Juneteenth holiday.
The items were collected by Homeland Security officials during the March 2024 raid at the disgraced Bad Boy mogul’s mansion in the exclusive Holmby Hills area of Los Angeles.
Investigators also found bags containing ketamine, which were also photographed as evidence.
Diddy complained about having to pay too much for escorts in texts shown to jury
Diddy griped about being nickel and dimed for the cost of escorts, according to messages between him and a woman named Bridget Collins with Cowboys 4 Angels – a male escort service in New York City.
While asking her if she had ‘entertainment,’ Diddy told Bridget to ‘stop raising my rate’ because he’s ‘a long time (customer).’
‘It’s about the guys, you want the best guys (they have the best rates),’ she replied.
‘I have a surprise if that’s OK, don’t want you feel like (unclear) sexy. Sending pic now,’ Diddy responded.
